The Arizona Real Estate Law Book is a compendium of excerpts from

• The Arizona State Constitution,
• Arizona Revised Statutes, and
• The Arizona Administrative Code

These relate specifically to the authority and responsibility of the Arizona Department of Real Estate to administer the licensing of the real estate profession in the state of Arizona. The Arizona Real Estate Law Book is published for the convenience of real estate licensees and the public. It is revised annually to reflect changes to Statutes and Rules since the last edition.

The Arizona Real Estate Law Book is limited in its scope, in order to focus on just those parts of Arizona State Law that relate to the Department of Real Estate and to licensing of real estate professionals. Pursuant to A.R.S. § 41-1033 Any person, in a manner and form prescribed by the agency, may petition an agency to request the making of a final rule or a review of an existing agency practice or substantive policy statement that the petitioner alleges constitutes a rule.

Pursuant to A.R.S. § 41-1093.01, An agency shall limit all occupational regulations to regulations that are demonstrated to be necessary to specifically fulfill a public health, safety or welfare concern.

Pursuant to A.R.S. §§ 41-1093.02 and 41-1093.03, you have the right to petition this agency to repeal or modify the occupational regulation or bring an action in a court of general jurisdiction to challenge the occupational regulation and to ensure compliance with A.R.S. § 41-1093.01
